Charge against top Fireman dismissed Fire Commissioner, Seve Tony Hill, is a happy man.  The man in charge of the Fire and Emergency Services Authority (FESA) left the District Court a pleased man yesterday after an assault charge against him was dismissed.

Police withdrew the charge against Seve because the key witness in their case had informed them he could not attend. He is in New Zealand.

Prosecutor Sergeant Solomona Natia said the man informed them he was unable to appear in Court for the hearing into the matter “any time this year.” As a result, he requested the charge be withdrawn against Seve.

Judge Mata Tuatagaloa, who presided over the matter, accepted the application Leota Ray Schuster, who represented Seve, reminded the Court that when the matter was last called, the prosecution assured them the hearing would go ahead. As a result, he told the Court that his client was seeking costs from Police.

Judge Tuatagaloa said there was no note of this request in the file before her of the matter.  However, Leota insisted that he had made a request in Court during the last mention of the matter. Finally, Leota asked that a memorandum for costs be filed on his behalf. This was granted.
